Petitioner's wife, the witness was perfectly capable of.
speaking English if she wished to do so, and did in
fact so speak in English to Your Petitioner's wife, and
although Your Petitioner can prove that she was prior
to her marriage employed as a telephone operator,
involving a knowledge of English and Chinese.
Mrs. Xavier was hopelessly confused as to time and date and wee set right by the committes in a way which would
not have been allowed in a Court of Law.

(e). That the only evidence of indecent assault on the first
occasion depends entirely upon her evidence, in which several discrepancies appear, as, at the beginning of
her evidenc she admits that Your Petitioner asked to inspect the kitchen, and that on the second occasion when she opened the door, she asked Your Petitioner if he wished to see the kitchen, whereas in corse-examina- tion she denied this, Your Petitioner's main point being that he went there in the course of his duty in order to inspect an illegal partition and bed at the
back of the premises.

That with regard to the second occasion Mrs. Xavier's evidence is surplemented by that of her husband and -- Your Petitioner submits that the that of her brother. husband's evidence is clearly blassed, and that the brother's evidence is absolutely unreliable as he states that he was concealed under the bed, and yet was apparently able to see everything that went on.
