its release, was confiscated. The legality of the seizure is up-

-held on the ground that the contractors concerned had violated

mining regulations in not taking out permits to quarry. It is here * unnecessary to recapitulate the arguments adduced for the re-

-lease of the stone seized or the other methods of solving the

difficulty which Mr. Jamieson has from time to time in writing suggested. The fact remains that, ever since the Green Island

Company has been unable to obtain any stone at all. The utmost

stress has been laid by the Industrial Commissioner on the point

that the contractors were aware of the existence of the Mining

Regulations and that they have to be punished for failing to com-

-ply therewith, but as the regulations in question would appear to

be identical with those promulgated by the Imperial Authorities,

although never enforced because they did not fulfil China's

obligations under the Commercial Treaties of 1902 in so far as

they affected the Foreign Powers, and as it is common knowledge

that many decrees of the Republican Government Presidential and

Provincial have been published but have either been rescinded

shortly afterwards or have remained in abeyance, the neglect

of the contractors on the circumstances to conform in this particu-

-lar instance may not be without excuse. In view of the large and

well known British interests at stake, in so far as limestone is

concerned, one cannot moreover help expressing surprise that pre-

-vious notice of intended strict enforcement was not given to His

Majesty's Consul-General, who would have made it his business to

see that all formalities were duly complied with. The absence of

such notice, taken in conjunction with the previous attempt to

establish a monopoly contrary to Treaty, would, as stated above,

render it difficult not to believe that there existed an intention

thus indirectly to kill the Green Island Company's competition

with the local Cement Works, who were sure of an exclusive source

of supply from the quarry confiscated by the late Imperial

Government.

However that may be, it is on record that applica

-tions in all respects conforming with the lining Regulations have
