IV. Any Labourer instead of working for day wages may if desired by

his Employer be required to do piece work at the rates as set forth in the Schedule hereto, but the Protector shall have power to relieve the Labourer from this obligation. The Employer however shall be entitled to require the Labourer to enter into an Agree- -ment with him to properly prepare a field (about 6,400 square yards) and plant, harvest,, cure, sort and bale a crop of Tobacco of 16,000 to 20,000 trees on the usual terms in force upon Tobacco Estates; prices paid to depend upon the care and attention shown in the production of the Tobacco crop and are to be assessed by the Employer or his Assistants at the rates stated in the Schedule to this Contract.

(i). From the date of entering into a field agreement to the date of harvesting his Tobacco crop the Labourer is entitled to obtain advances up to 87 per month, and on Ch Chinese New Year Holidays an extra advance up to 85. Such advances to be deducted from the amount payable for his Tobacco crop.

(ii). During the continuance of such field agreement the

labourer shall not be entitled to claim daily wages or payment for work done overtime until after the harvesting of his Tobacco crop. (iii). If through no fault or neglect on the part of the labour-

-er the Tobacco crop fails he shall in no case receive less than 33 cents per day for the number of days he has been working on the field under the above mentioned field agreement.

). The term of the within contract shall be extended until such time as the said crop of Tobacco is ready for mar- -ket.

Any Labourer who shall have entered into this contract and shall subsequently be desirous of settling in Borneo shall, on production of a discharge certificate duly signed by his last Employer and by the Protector, be entitled on the following conditions to one acre of land for each year he shall have resided in Borneo at the time of such application, but not exceeding two acres in all:-

(a). Application shall be made to the local Land Office with-

-in six months after the completion of this contract. (b). Belection shall be made forthwith, and shall be subject

to the approval of the Government. (c). On approval of selection a lease shall be granted for

99 years free of premium, but carrying a rental of one dollar per acre per annum, such rental not being due in
