It seems to me that the real issue has been

obscured by side issues trougout. The facts of the case are

simple. On Saturday 22 October, 1910, the shroff was sent to pay

money into the bank, after I had personally found fault with him

for not having delivered certain bills, which he tuen had in his possession, for comparatively large sums owing by certain shipping firms. He paid the money into the bank, and returned to the office with the bank receipts for the same. It was then nearly 1

o'clock. I had told him to deliver the bills love referred to on

the Monday (24th.), but it would seem that he went out again then and instead of merely delivering the bills to the several firms,

in direct defiance of my orders, he proceeded to collect the suns

owing on account of the bills from the firms concerned, apparently

in cash, and tuen promptly decalped from the Colony. These shipping

firms had all been warned by me, both in writing and verbally,

against paying any suns at all to the shroff, and had signified

the ir acquiescence in the new arrangement, whereby they were to

pay all fees due by them to this Department by theque or Compra-

-dore Order to this office. Had they carried out that undertaking

no defalcations could have occurred.

I submit that none of the actions or omissions

stated in the above charges could have contributed in any way to

the shroff's dis nonesty, and that no possible action of mine,

dictated by the information in my possession, could, under the

circumstances, have prevented the theft.
