An Ordinance to amend the Opium Ordinance,1909,'

Α for delivery under permit to a warehouse; it prescribes the form and nature of such permits; gives the Superintendent of Exports and Imports power to make it a condition of such landing permit that the Raw Opium in question z be placed in a warehouse in the case of Raw Opium other than Indian Opium certified for the China markety and also gives the Superintendent authorit to demand the production of such certificate in the case mentioned above.

Section 3 e, prohbits the removal of Raw Opium for exportation withou permit; prescribes the form and nature of such permit; gives the Superin- tendent authority to call for any mercantile or other documents which will
satisfy him as to the true destination of such opium and also prohibits” the
exportation of Raw opium to any place which has been notified in the Gazett
in pursuance of ant`resolution of the Legislative Council as being illegal. This Section also provides that the Master of any ship carrying Raw-optum f
exportation shall be furnished with a Memorandum containing the particulari
of such export; and prescribes a penalty in the event of contravention of
this clause by the Master. The Section also prohibits the removal of Kay opium within the Colony without permit; gives the Superintendent of Export and Imports power to make it a condition of such export permit that the Raw opium in question must be placed in a warehouse in the case of Raw opium óti
than Indian opium certified for the China market; and also gives the Super
intendent authority to demand the production of such certificate in the cas
mentioned above. The section also provides that those in authority over
ship importing opium must within a reasonable period after the arrival of their ship, furnish the Superintendent with particulars of the opium import

increases the penalty for contravention of Sections 10,
11, 12, 14, 15 and 16 which Sections in the old Ordinance of 1909 are re-
pealed by the present Ordinance and are enacted in Section 3, Sub-sections
c, d and e.

Section 3 g, increases the penalty in Section 20 of the old Opium
Ordinance 1909′ which deals with the unauthorized importation or or defi-
ciency in stored Raw opium.

9*** Section 3 h, limits the amount of Prepared Opium which the Opium
Farmer may sell without written permission of the Superintendent to any
person other than his licensees to 5 Taels;~~ similarly limits the amount
the which a licensee of a Farmer may sell to any person, and also similarly
limits the amount of Prepared Opium which a person other than the Farmer or
his licensees may have in his possession.

Section 3 1, repeals Section 36 of the old Opium Ordinance 1909 and substitutes a new Section by which the exportation of Prepared or Dross Opium is prohibited without the Superintendent's permission,safe guarding however the ́use by a passenger of a moderate amount for his personal con- sumption..--The object of this Section was to avoid a difficulty which arose owing to the decision of the Supreme Court to the effect that a pro- secution-in respect-of-illegally exporting opium could not be successful unless the place of destination was clearly proved; a fact which however
rendered the circumstances connected with the smuggling it was frequently impossible

11. Section 3 j, repeals Section 37 of the åld Opium Ordinance 1909 and prohibits the Superintendent- from issuing permits for export of Prepared

and making it an^offence for any person to export such opium to any such
country, safe ̈guarding the provisions however by an allowance for the per-
sonal consumption of passengers and by prescribing that a list of the pro- hibition countries shall be publicly notified in the Gazette. 12.~~Section 3 k, increases the penalties applicable under Section 51 of the #2# Optum Ordinance 1909 which deals with the illegal importation, (manufac- ture or dealing in Morphine or other compound" of "Opium. 13-Section 3 1,- similarly increases the penalty in the case of contra- vention of^Section 53 of the Old Opium Ordinance 1909 which dealt with the
