Re Persian Opium.
As arranged at our interview this morning, we saw Mr. Kemp
and fully explained the position of this case to him.
Mr. Kemp agrees with us that in view of the facts (a) that Goldenberger personally attended to the shipment of the opium on board the S. S. *Caledonien", and not Woodward as we had been previously instructed, and that Sergeant Wilden cannot swear that Woodward, to his knowledge, took any part in the actual shipment of the opium,
(b) that the shipping clerk in the French Mail Offices, whom
we interviewed some two months ago and who issued the Bill of
Lading to Woodward personally and was acquainted with him,
has left the Colony and the Manager informs us will probably
not return to this branch,
it is extremely improbable that the evidence which could be adduced
would justify a lagistrate at home an ordering the Defendant's return
to Hongkong.
As matters now stand we could prove:-
(1) That the opium was our clients.
(2) That it was removed from Apcar's godown on 26th. December
at Woodward's instructions, and with our client's know-
-ledge, to Woodward's Godown.
(3) That a permit to export was obtained by Woodward's clerk
Mantei on 30th. December and signed by him.
(4) That the opium was shipped on 31st. December under Golden-
-berger's supervision.
(5) That Woodward disappeared on that date.
(6) That our claint took immediate steps to stop the opium
and trace Woodward.
(7) That Goldenberger has since absconded from the Colony.
We could not prove:-
