It is different when the offence for which

extradition is being sought by this Government is an offence against society and one in which this Government directly under- -takes the prosecution: in such cases if the Country petitioned is

one in which the expenses of the demanding administration are

paid by the petitioned state there would be no difficulty; but, if

the Country from which the fugitive is claimed is one which de- -mands that the petitioning state shall pay the expenses of extradition it is usual for the petitioning Government to forward

an assurance that it will pay whatever expenses are incurred. And

in Cyprus we used to use in Covernment cases a form of indemnity

similar to that contained on page 26 of the memorandum mentioned above which form was forwarded with the application papers.

In all i.e. private and public, cases, how-

-ever there are certain petty expenses which one may bunch under

the head of Police Ezpe ses as they form part of the ordinary

Police Expenses of an administration. You will see a reference to

this on page 3 of the memorandum quoted above. These are paid by

each Ad...inistration.

Now, conversely, when an application is made

to our administration by a Foreign Ad...inistration for extradition I should think we should be governed qua expenses by the Treaty if

any which exists between us and the requisitioning country; indeed

in the case of an application made to us by a country which had

no Treaty clause with us by which we undertake to pay or to

renounce any claim for payments of its extradition expenses any

claim for extradition wade by such State ought I think to be

accompanied by an assurance that it would indemnify us for our

costs: it would be quite fair for us to charge such a country not

only our actual out-of-pocket expenses (putting aside the petty Police expenses to which I have referred above) but also reason-

-able professional charges for the services of any person who appears before the magistrate and does the substantive work in

obtaining the extradition.
