age of the abducted woman and in consequence the accused was dis-

-charged, it would not be possible for the prosecution, having remedied

the defect in its evidence, to prosecute the person again.

The English Habeas Corpus Act lays down that no person

who has been discharged from custody on a Habeas Corpus shall be had

up for the same offence.

Now if one applies the rule strictly in this case it is

extremely likely that the Supreme Court would on an application for a Habeas Corpus discharge Sotto from custody and in my opinion would probably say that these 2nd. Extradition proceedings ought never to have been allowed to continue.

Sotto was discharged before because it was held by the Supreme Court that the requisition for his extradition was made by the wrong U. S. Officer and secondly because the documents had been not properly authenticated. These defects in procedure have been remedied but supposing Sotto tekes out another Habeas Corpus he will argue that to arrest him again in connection with precisely the same matter is legally wrong. I admit that it is difficult to say positively that the rule of the non possibility of re-charging with the same offence an acquitted person is categorically applicable in the case of extra- -dition applications but I think it probably substantially is.

With regard to the second point mentioned in 5 B. This is, of course, rather a delicate matter. It was referred to at some length in the Judgment of our Supreme Court on the hearing of the Habeas Corpus. The fact that for four years and more this man was not proceeded against and that application against him was only made after he began to publish his newspaper here lends colour to his sugestion that the real object of these proceedings is to ob- -tain his return to the Philippines more from a vindictive wish to punish him indirectly for his political virulence rather than for his abduction of the young woman.
