14. (2) Opium, other than pure opium and preparations or admixtures of opium used for smoking, may

be manufactured by any medical practitioner who has obtained a license to sell opium for medical purposes.

15. Any person may, without a license, at any one time possess-

phia and its preparations shall have been manufactured, imported or purchased in a manner authorised by these rales.

Provided alro that a person who has been registered under a European or American Medi- cal Act or who has received a Medical diploma from an Indian University or College may possess morphia or its preparations in quantities exceeding 10 grains as required for the exercise of his profession.

19. Subject to the conditions of his license, a medical practitioner who has, in manuer hereinafter provided, obtained a license to sell opium, for medical purposes, may possess opium, other than preparations or admixtures of opium used for smoking, in quantity not exceeding that specified in his license.

20. A person who has, in manner hereinafter provided, obtained a pass for the transport, import or export of opium may, subject to the conditions of such pass, possess opium, other than preparations or admixtures of opium used for smoking, in quantity not execeding that specified in the pass.

(2) The Deputy Commissioner shall, in respect of each such license, fix, and shall record in the license, the maximum quantity of morphia and preparations thereof.

Provided that he shall not fix less than the following quantities, namely:

3. Every license for the sale of opium by a medical practitioner, for medicinal purposes sball be

* subject, in addition to the conditions hereinafter following,

to such conditions consistent with the provisions of the Opium Act, 1878, and of these rules,

as the Financial Commissioner may, from time to time, prescribe :-

(a) the license-holder shall not sell

*morphia and its preparations to aLy person other than those referred to in the second proviso to rule 15, except on the prescription of a qualified medical practitioner.

Transport.

27. Opium may be transported by---

(a) any Government officer acting, in regard to such transport, in the performance of

his official duties,

(6) any medical practitioner, duly licensed to sell opium, in such quantity as added to his stock in hand, shall not exceed that specified in his license and for the pur- poses of his business as such practitioner.

(5) A medical practitioner, who imports opium, other than preparations or admix- tures of opium used for smoking, shall pay in resport of such opinm, when imported by sea, such duty as may be leviable thereon under the Indian Tariff Act, 1891, as amended by Act III of 1896, or any other law for the time being in force, aud shall comply with any further conditions regulating such import as may be prescribed by the Financial Commissioner from time to time.

"Morphia", when sold in any quantity not exceeding five grains avoirdupois in weight, phall be deemed to be sold by retail", and when sold in any larger quantity shall be deemed to be sold "wholesale ";

(xiii)

"Medical practitioner " means a person who has been registered under an English Medical Act or who has received a medical diploma from an Indian University and who practises medicine according to European methods;

(xiv) "Pharmacist" means a person who deals in European medicines and drugs as a means of livelihood, and "licensed pharmacist" means a pharmacist to whom a license has been granted by the Deputy Commissioner.

Any person may possess morphia not exceeding five grains avoirdupois in weight, provided that he has bought such morphia from a medical practitioner, or from a licensed pharmacist who has been specially licensed to sell morphia, in pursuance of a prescription of a medical practitioner, and provided that he requires it for medical purposes only.

14. Subject to the conditions of his license a licensed pharmacist may possess any quantity of morphia not exceeding three ounces avoirdupois. But in special cases the Financial Commissioner may authorize the possession of such larger quantities"
