I am directed by the Secretary of Baty for
RG13 NOV 12 Foreign Affairs to acknowledge the receipt of your
Hon
letter of the 8th ultime which has received his careful
consideration.
You complain that the substance of his instructions
to His Majesty's "inister at Peking touching your can-
didature for the appointment of legal adviser to the
Chinese Government was not immediately communicated to
you, and you request that those instructions be with-
drawn.
I am in reply to observe that instructions to
His Majesty's diplomatic Representatives explaining the
views of His Majesty's Government as to the suitability
of particular candidates for appointments under a
foreign government are necessarily confidential; no oc-
casion arises to act upon them until the creation of
such appointments is definitely decided upon and Pis
Majesty's Government are consulted in the matter. You
are aware that, so far as your candidature is concerned,
the occasion has not in fact, up to now,
arisen. For
