With reference to your letters Nos.3046 and 5723
of February 13th. and March 6th. respectively, I am
directed by Secretary Sir E. Grey to state, in reply,
that he concurs in Mr. Harcourt's view that New Letters
Patent should not be issued, and that the prerogative
of pardon should be exercised in respect of persons
imprisoned at Hongkong under sentences imposed by His
Majesty's Courts in China, by the Secretary of State
for Foreign Affairs. This would be in accordance with
the China Order in Council, 1904, and the principle
embodied in the Colonial Prisoners Removal Act of 1884.
