Sir:-
I have the honour to acknowledge receipt of your des-
patch No. 245 (49096/11) of the 9th. ultimo, transmitting
copy of a letter from the Board of Trade on the subject of
the proposed Anglo-Japanese Convention for the mutual pro-
tection of patents, trademarks and designs in China.
I am entirely in accord with the proposals put forward
by the Board in this letter although I still think it ex-
tremely unlikely that the Japanese Government will agree to
afford protection to all these unregistered marks in China
for which prior use can be claimed. As, however, the (lov-
ernment are at present contemplating the introduction of a
measure which, if passed, would partake to some extent of
the nature of our Merchandise Marks Act, the outlook is more
hopeful than it was when these negotiations first began
