of his service in the Naval Yard. They regarded that service,

however, as "other employment under the Crown" and I am of opinion

as stated in paragraph 3, that Mr. McEwen has bede out his case

and that he comes under the designation of "Officers appointed

before the lst. July, 1897* in General Order 120 (c).

I consider that the statement in the Certifi-

-cate quoted in paragraph 4 that Mr. McEwen resigned the Police

Force on the 12th. September, 1896, is not correct. He was trans-

-ferred to the Naval Yard Police Force by the Governor. He should have been transferred by the Governor-in-Council, as required by

Section 12 of the Pension Minute, but I do not think that Mr.

McEwen should be made to suffer for such a technical breach of the

regulations, for which he was not responsible.
