Excellency's letter was carefully considered by the Committee.
The laws which govern transactions in land in the Island of Hong- -Kong and the New Territories are not the same and though it is probably impracticable to impose any restrictions in the case of
land already held under lease from the Crowm, the Committee is of
opinion that action might be taken in the future on the follow-
-ing lines:-
(a),
In the old colony, by inserting specific words in
all Crow leases limiting the right of transfer to British sub-
-jects ofpersons approved by the Crown. The lessee might also be
required to give notice to the Crown of his intention to sublet,
mortgage &c., and it might be stipulated unat all such trans-
-actions should be subject to the consent of the Crow.
(b).
In the New Territory, the Committee understands
that (Ordinance No. 34 dated 1910) Part II, Section 14) the
practice has been for all land deeds tobe made at the Land Office,
so that the District Officer and Assistant District Officer are
cognisant of the transfer at the time when it is about to be made. The Committee, however, considers that here also it would be well
to insert specific words in all leases issued in future, and as it has reason to believe that since the Convention few
beases
have actually been issued the opportunity still presents itself for making any reservation on behalf of the Crown that may be thought desirable. As regards land in beneficial occupation in the New Territory prior to the Convention of 1898 it is stipulated in the Convention "that there will be no expropriation or expulsion of "the inhabitants of the District included within the (Kowloon) "extension, and that if land is required for public offices, "fortifications, or for like official purposes, it shall be bought
"at a fair price".
In view, therefore, of the different conditions which exist between the old Colony and the ilew Territory the Committee is of opinion that the unrestricted right of sale, have the
transfer, &c., given by Section 2 of Ordinance 1 dated 1853 in sikia prawe wig and respect of property situated in this Island should not be extend-
