Sub-section (3) retains the priority in the

373 decision of the Senior Judge where the two judges differ, when sitting otherwise than in appellate jurisdiction, but contains new matter by conferring the right on any party agrived to appeal to a Full Court of 3 judges.

Clause 5: retains appeals in interlocutory matters etc., to the Full Court of 2 judges giving to the Court of three Judges (with the Judge of the Court in Chine) jurisdiction on appeals from Original Jurisdiction. The retention in the existing Full Court of appeals in the matters specified is certainly necessary and the hearing of appeals from Original Jurisdiction will probably take up all the available time of the Court of three judges.

Sub-section (2). The suggestion of the Secretary

of State that the barrister to be temporarily appointed by the Governor should be of 12 years standing is, it is submitted, not practicable here owing to the scarcity of barristers available, and seven years standing at home qualifies a barrister, I think, for appointment to the County Court Bench and ten years standing to the High Court Bench, whereas in India the qualification to the High Court Bench is five years.

Clause 7: The Ordinance will not come into operation until the retirement of Sir Francis Piggott.

I deem it unnecessary to insert in the Bill any reference to the dates of hearing appeals in the case of the Full Court with three Judges (including the Judge of the Court in China) as I think it had better be a matter of mutual arrangement between the Judges but of course the present scheme would be adhered to i.e. two sessions of approximately fifteen days each in the year, and the dates would necessarily be determined some-

by -time in advance of Sir Havilland de Sausmarez and the Chief
