Referring to my minute dated the 5th. day of September 1911 re Duty Pay, and to the reply thereto that duty pay is only pay- able in respect of appointments which are preferential to Cadets I have looked through the Secretary of State's despatch dated the 9th, day of saroh, 1911.

It seems clear to me that the Secretary of State intends duty pay to be paid to all European officers serving in the tropics in all those Departments of the Hongkong Service which are ordinartly recruited in Europe. Certainly to those holding poate for which Cadets are eligible.

It may be that duty pay is not payable to European Officers serving in posts for which Cadets are specially excluded, such as the Land Office but the post of Assistant Grown Solicitor is not one of those, indeed it is specially declared to be one for which Cadets are eligible and I can only assume that were the post hald by a dadet he would receive duty pay. It appears that the Deputy and Assistant Superintendents of Polce receive duty pay although such posts are exoluded how to Cadets. I may add that the post of Assistant Orown Solicitor is a responsible and difficult one to fulfil and involves much work that is technical, work also that needs special qualifications. Indeed it is far more oneroue in comparison to many other third olase poste and if it is to be excluded from duty pay it is reduced to a post carrying in com- parison a very small salary, in fact is placed below Class III. When I accepted the post I certainly understood that it came under Olass III which is £400 to £560 by £20 annually with Duty Pay of £100.
