The reply then to His Excellency's hypothetical con- -tention would seem to be two-fold. In the first place it is not probable that Japan would consent to sign a treaty which bound her to recognise in China a British merchant's claim to a mark which was in Japan the exclusive property of a Japanese merchant; and secondly, even if such a treaty were signed, the British merchant would have but little confidence in the prospect of its satisfactory inter- -pretation by the Japanese Consular Courts in China.
