what action could be taken under the amended ordinance.

appears that as Mr. Heermann was not committing an offence

by being in possession of plans on the 5th November, 1910,

the only way in which he can be dealt with is by the issue

of a search warrant against him on the ground that evidence

shows that he had plana in his possession on the 5th Novem-

ber. Such search might not result in the discovery of the

plans in his possession, as he may possibly have got rid of

them when the new Ordinance was passed. Under such a contin-

gency the position would be an unpleasant one, and would lead

to ill feeling amongst the Germans in the Colony, and possibly

to more serious trouble.

I request instructions as to what, if any, action should

now be taken by me in the matter.
