I am to enclose for Mr. Harcourt's

information a copy of the opinion of the Law Officers

of the Crown at that time. This opinion would seem to

be in harmony with the view taken by the Magistrate at

Hong Kong which is also supported by the Attorney

General of that Colony.

It therefore hardly seems necessary at this

juncture to refer the matter to the present Law Officers

unless and until the United States Government address a

diplomatic representation to His Majesty's Government

on the subject.

This, notwithstanding the views of their Consul

General at Hong Kong, it seems scarcely likely that they

will do, having regard to the fact that in the case of

a British subject who was charged with embezzlement in

Japan in 1875, Mr. Cadwalader, one of the Secretaries

in the State Department at Washington wrote as follows

to Mr. Bingham, the United States Minister in Japan:

"The tenth Article of the Treaty with Great Britain

"of August 9th, 1842, provides for delivery, on mutual

"requisition of persons charged with certain specific

"offences
