It would I think be in derogation to our
treaties with Chine to do otherwise were a Chinese the
petitioner.
It appears to me that the signatories of the second
memorandum are blowing hot and cold; in dealing with
Manila Companies they call in aid the effective control
of the American Courts, whilst they object to full control
by British courts!
I may add that it is not sought to deprive the
Hongkong Courts of any of their jurisdiction; should they
make any order it will have the gume respect and be
treated in exactly the same wey as the order of any other
of His Majesty's Courts, Nor is it sugrested that this
Court can make any order affecting the register in
Hongkong.
Foints of general policy I have the honour to point
out are rather for His Lajesty's Minister than myself.
I do not know whether your Excellency has communicated
with him, but it would I think he desirable that you
should do so. I may add however that the attitude of
the Hongkong bar inclines me very strongly to a Shanghai
Zizy
register.
