Sir:-

I am directed by Secretary Sir E. Grey to acknow-

ledge receipt of your letter 6367 of the 4th instant

respecting the case of 0. Yung.

You are aware from my letter of November 18th,

1907, that the claim of 0. Yung was presented to, and

rejected by, the United States Government in that year

and that Sir E. Grey proposed in the absence of any

stronger evidence to take no further action in the

matter.

The case is one which is eminently suitable for

determination in a law court and it is therefore

regrettable that the action of the United States Govern-

ment should have prevented the courts at Hong Kong

from clearing up the facts. If, however, the case

were now to be brought before the Claims Commission it

would be necessary for the Commission to deal with it

as it would be dealt with by a law court.
