I have finally to draw Your Excellency's atten-
tion to the very serious financial loss which the decision
will entail upon me if it is maintained. Unleas I complete
7 years' actual service I shall not get the benefit of Rule
2 in the calculation of my pension; and in addition to losing
full pay for every year that I am prevented from serving in
future I shall also lose a sum of £ 66 a year on my pension.
I submit with confidence that these are not consequences which
should follow on giving honest advice to the Government, unles
some reasonable compensation is offered to me.
I have only to add that if in spite of my criticisms the
Government decide to put the scheme into execution I will
continue to do what I have already done, assist the Govern-
ment in putting it into working order, leaving it to time
to shew whether my criticisms are well founded or not. My
experience in such matters will probably be of assistance to
the Government. If it is decided that the scheme is to be
put into force I submit that the question of precedence shoul
be settled after consultation with the Lord Chancellor, and
I am confident that he will advise that the etiquette of the
Bench is as I have described it in paragraph 2 (o) of my
letter of 10th, November 1908, and that the question should
be settled by reference to that etiquette.
