With regard to the query in the letter under reply
I have the honour to inform Your Excellency that even should, as I
do not contemplate, the decision be maintained, I do not propose to apply for leave prior to 30th. April next.

On my return from leave Your Excellency was good enough to give me an interview at which I laid before you both my objections to the course which had been taken by the Secretary of State and the Executive Council as well as many reasons why it would
be highly prejudicial to the interests of the Colony to introduce the scheme. These objections are embodied in this letter, and the reasons
are annexed in a separate memorandum.
I much regret to find on my return from leave that for some time past during my absence it was bruited abroad in the Colony that I was being "retired for age". As this does not in the least represent the facts, it is desirable in order to prevent any
it inisconception that what has happened should be clearly defined is this:- advantage has been taken of a provision in the law as to retirement for age because I criticised adversely the proposed scheme for a new Appeal Court which it is not intended to introduce: in other words, it has been intimated to me that I am to be dismissed from the service because I honestly pointed out the palpable defects of the proposed scheme. Such action on the part of the King's executive officers must manifestly be highly detrimental to the service. The effect of it will inevitably be seriously to hamper officers in advising the Government, for they will know, from this precedent, that steps may be taken to get rid of them at the earliest opportunity which the law allows. The Government stands in need of the best advice its officers can give it; and it has been one of the beat traditions of the English Civil Service that that advice can be
