before the new Appeal Court.

Hearings now taken originally before the Full Court: which of themselves raise a complicated question of policy which I have already hinted at.

H. Since the question was first mooted another point

has arisen which requires the most careful consideration

by the Government. For reasons which are not altogether

apparent the work in the Summary Court has increased in

importance during the last three years, and there is still

a tendency in the same direction. Cases involving important

points of law frequently occur, the Puisne Judge often

gives written judgments which are sometimes included in the

Law Reports. This fact also increases the tendency to

appeal from his decisions. Meanwhile the bulk of Summary

work is also increasing. The time occupied by the Puisne

Judge in the new Appeal Court will take him away from the

Summary Court more than is advisable and this will further

increase the congestion.

The Puisne Judge is strongly of opinion that the

time has arrived for the creation of a real Small Debts

Court and I agree with him, At present the only way of

doing this would be to give civil jurisdiction to the

Magistrates; but this is not feasible, for their time is

fully occupied as it is. A third Magistrate would therefore

have to be appointed. The cost of an additional Magistrate

together with the cost of bringing the Shanghai Judge to
