acted as Chief Justice for ten months, has expressed the
opinion that the proposed time of 14 working days will be
sufficient, even though this opinion is qualified in the
case of a possible long appeal.
I must point out that I have never been informed
as to the length of time which it is proposed that the
Shanghai Judge should spend in the Colony. When I first
criticised the scheme I assumed that the bi-annual visit
would last a month, and I estimated that this would give
twelve working days, so as to allow the rest of the Court
work to go on. In Mr.Langley's letter of 11th.March, 1909,
it appears to be suggested that the sessions will only last
a fortnight; but I gather that the idea now is that each
session will be composed of 14 working days. On this basis
I think that the session will in normal circumstances be
sufficient for the hearing of the appeals pending, though,
speaking with six and a half years experience of the Court
work, I cannot give a positive opinion; for there are two
uncertain factors in the case first, the mere existence
of the new Court will without doubt foster appeals, though
to what extent cannot at present be appreciated; secondly,
the calibre of the Chief Justice for the time being must
inevitably affect the number of appeals from his decisions.
But of this I am certain, that in circumstances which are
not normal the time will not be sufficient.
When I first criticised the scheme, work in
Original Jurisdiction was so congested with heavy cases,
and the prospect of appeals was such that no one with the
least knowledge of the work of the Court would have ven-
tured to advise the Government that the scheme could have
the slightest chance of success; the scheme was put forward
