I have the honour to acknowledge receipt of
your Confidential Despatch of September 27th. informing me that
you had decided with the concurrence of Sir E. Grey to arrange
for the constitution of a Court of Appeal for this Colony by the
addition of one of the Judges of His Majesty's Court at Shanghai.
I consulted Mr. Justice Gompertz on the
subject, and also the Honourable Ir. H. E. Pollock, K.C. who had
assisted in drafting the original Ordinance mich accompanied my
Despatch Confidential of 26th. January, 1909. I did not at once
consult Sir H. de Sausmarez as suggested in your Despatch for I had received a private letter from Mr. Rees-Davies in which after
R talking to Mr. Bisley at the Colonial Office, he had proposed
that consultation with Sir Havilland should be deferred until his
own return to the Colony as he had talked over the subject at
length with Sir Haviland in England and the bill would not be passed until after the retirement of the Chief Justice. I desired | moreover when sending the draft to Sir Haviland to be able to submit for his opinion the various criticisms offered on the
draft.

Mr. Gompertz makes certain suggestions, but in no way opposes the proposed constitution of the Court, and considers the estimate of two sessions of 15 days each per annun
a reasonable one, especially if his own suggestion to establish
