If the Lessees wish to berth a stemmer at the said Wharf for the purpose of loading coal (either into bunkers or as cargo) into such steamer they must first obtain the written permission of the Lessor and pay such charges as may be mutually agreed upon.
8.
Should the Lessor require to use the said Wharf for any purpose connected with the Railway he shall be entitled to so use the same PROVIDED that if a steamer of the Lessees is berthed at the Tharf the Lessor shall give the Lessees not less than 48 hours notice of his desire to use the same, and the Lessees shall remove such steamer from the said Wharf before the expiration of such period of 48 hours. 9. In the event of a State of War or Strained relation existing between H. B. M. Government and any other Power the Goverior of Hongkong may take possession of all or any part of the coal stored by the Lessees on the said plots of land and say dispose of such coal as he may think fit; and the Lessees shall be entitled to receive payment, for the coal so taken at the average rate current for the preceding six months plus 2 per cent to be settled by Arbitration in case of dispute.
10. During the currency of this Agreement the Lessees shall have the use of the plot of land marked (50' by 30') on the annexed plan for an Office, and may erect thereon a suitable building for that purpose in accordance with plans and specifications to be approved by the Les- -sor the Lessees may also instel a telephone in such Office, and allow not more than three caretakers or watchmen to sleep there. 11. The Lessor will at his om expense forthwith repair the deck planking of the said wharf, and thereafter the Lessees shall keep the said Wharf in as good a state of repair as it is in when the Lessor has so repairdd the planking, reasonable wear and tear and darage by storm excepted: all repairs to be made to the satisfaction of the Lessor.
12. The Lessor does not guarantee that the said Wharf is in any way sufficient for the berthing of any vessel or the working of any cargo: the Lessees shall use the said Wharf by such user: reasonable wear and tear excepted: overy steamer berthing there must also moor
