(c.) In order to obviate the difference in exchange and to simplify accounting, rates will be quoted in the Goods Tariff at a uniform face value, which will be entered on each consignment note with a statement of the amount thereof due to each Section. For goods transmitted from the Chinese Section to the British Section the Chinese Section will collect the amount due to it prior to despatch and Corward the consignment note to the British Section showing the outstanding amount payable to that Section, which amount will be collected by the British Section prior to delivery. Similarly for goods trausmitted from the British Section to the Chinese Section the British Section will collect the amount due to it prior to despatch and forward the consignment note to the Chinese Section showing the outstanding amount payable to that Section, which amount will be collected by the Chinese Section prior to delivery.

Maintenance.

33. Each Section agrees to maintain the road and works under its charge in such a state of efficiency as will ensure the safety and rapid conveyance of passengers and goods traffic.

General.

34. Except as in this agreement provided, neither Section shall interfere in any way with the management or control of the other.

35. In confirmation of Article 15 of the final schedule hereto, the Directorate and the Governor undertake on behalf of their respective Governments that no part of either Section nor the control thereof shall at any time be transferred to persons of any other nationality except Chinese or British respectively.

36. In confirmation of Article 15 of the final schedule bereto, the Directorate and the Governor undertake on behalf of their respective Governments that no line competing with either the British or Chinese Section shall be built to the detriment of either Section and that no branch line or extension shall be built which could divert traffic to the detriment of either Section, without the consent of both Governments.

37. The collection of Customs Duties on dutiable articles received by either Section and destined for points in the territory of the Government of the other Section shall be governed by the Rules. contained in Schedule D hereto attached, when agreed upon between the Hongkong Government and the Imperial Chinese Government.

37A. The Chinese Government having intimated its intention of connecting the Railway with the line from Canton to Hankow, it is agreed that the principles of this Agreement shall be extended to any agreement made between that Railway and the Kowloon-Canton Railway or any part of it and that the British Section of the Kowloon-Canton Railwry shall be a party to any such agreement in so far as through traffic over the Railway is concerned. Rules for the interchange of traffic and rolling stock and for through bookings and through rates and other matters dealt with in this Agreement shall hereafter be settled by the Administrations of the Kowloon-Canton Railway and the Canton-itankow Railway.

Police.

37B. Euch Government shill provide such Kailway Police as may be necessary for preserving order and enforcing the law in and upon the premises of, and in connection with the business of, its own Section. In the event of any disturbance affecting the traffic of the Railway the Government on whose Section the disturbance occurs shall be responsible for all loss (including loss of mails) incurred by the other Government, and for any claims by individuals on account of hurt or damage to person or property, and for damage to Rolling Stork belonging to the other Section.

Suspension of Agreement.

38. Should either party to this agreement be temporarily unable at any time owing to war or rebellion to fulfil the provisions and conditions thereof, each party shall after due and reasonable notice withdraw all plant which belongs to it from the Section of the other party and may work its own Section independently of the other, arranging for the closing of the books and accounts up to the date of temporary suspension of this agreement. So soon as the cause of such temporary suspen- sion is removed, the provisions of this agreement shall forthwith come into operation again. Joint rolling stock (if any) shall be withdrawn by each Section in proportion to its actual mileage, due consideration being given to fair distribution with regard to age and condition of the stock at the time of withdrawal.
