simply on account of the escape of 5 passengers, when he had on board at the time armed officers of the government to prevent same, and by his not boarding the vessels on the day of their arrival without any persons whatever exeept that of purposely delaying the vessels. The wholesaler rejections of the passengers were foreshadowed by him long before the Ship's arrival, as in a conversation with the General Manager of the Company, who has at Salina Cruz in the latter part of April, 1908, he when told of the total number of passengers arriving by tha "Suisang", said that 300 or more would be rejected; which proved that the action was premeditated.

That in not consenting to the proposals of the Co. re the despatch of an independent expert oculist to Salina Cruz to examine the men, nor to that proposed by the British Minister for the appointement of a Commission of experts, the Government denied the Company justice and fair-play. Such denial was most arbitrary and contrary to all principles of Justice as it precluded all appeal from the diagnosesof its Sanitary Delegates when they have manifestly proved wrong.

That the Delegate in deporting the men already landed into the Co's barracks, especially in the case of the 136 men from the "Landratschieff", deported under an armed excort, exceeded his authority and usurped the authority of the Chief. 3xecutivę an such action virtually amounted to "expulsion", and action only within the province of the Executive. According to general practice such expulsion can only be decreed by the Chief Executive through its Ministry of Foreifn Affairs and after due hearing before the diplomatic representative of the nation to which the "expelled" is a subject or citizen.
