Alteration of levels.
Your letters of the 7th. and 22nd. November last addressed to the Colonial Secretary have been handed to me, and, in reply thereto, I am directed to inform you that the alteration in the level of Reclamation Street, Yaumati, was undertaken with a view to the reclamation of the area of fore- -shore or sea bed described in Section 4, Sub-section 4, of the Harbour of Refuge Ordinance, 1909, such work being necessary for the purpose of effecting the works authorised by that Ordinance. This reclamation has been contemplated for a number of years, and the necessary levels of the streets of Yaurati were fixed in 1907, since which date the work has been carried on by degrees.
The Colonial Secretary was not inforled of these facts when he wrote to Messrs. Wilkinson and Grist on the 1st. Larch, 1910, and was consequently led to make an incorrect statement.
Section 7 of the Ordinance above mentioned legalises (inter alia) the reclamation works including any accessory works.
Your clients' claims in respect of the alteration of the level of Reclamation Street cannot therefore be entertained except in so far as they form part of any claim under Section 12 of the Ordinance, in which case they will be dealt with as provided by that Section.
The alleged depreciation of value of your
clients' properties is not admitted.
