Because the Government, by Ordinance 21 of 1910, whereby, for the first time, it obtained Legislative Authority to alter the levels of public roads, expressly provided for compensation to be paid for injury occasioned by

such alteration.

Because section 9 of that Ordinance expressly discrimin- ated against our clients in respect of compensation for any levelling in carrying out the works authorized or validated under the Typhoon Refuge Ordinance. Because the principles on which the just Government of a country are based are, (inter alia) that, no man's

property shall be injuriously affected by any Act of the Government without compensation being paid there- for.

Because it is just and equitable that compensation should be paid.

We would further submit that the Typhoon Refuge Ordin- ance should be amended so as to provide for the Judge sitting with Assessors. If there is a wide divergency between the sum named for depreciation by the experts on one side and the sum admitted by the experts on the other no Judge would be

qualified to decide between them save with expert assistance.
