Report on Ordinance No... 12... of 1911

I have examined the accompanyiny Ordinance entitled

An Ordinance to amend the Flogging Ordinance, 1903

and I am of opinion that the Ordinance is one which is not contrary to the Governor's Instructions,

A draft of this Ordinance was submitted to His Majesty's Prin-

4-cipal Secretary of State for the Colonies as an enclosure in His Ex-

-cellency the Governor's Confidential Despatch of the 27th February 1911,

and subject to two alterations the draft was approved by a telegram dated

the 7th April 1911. These alterations were accordingly made in the draft

before the Ordinance was presented to the Council. The Legislative Coun-,

-cil have passed it without amendment.

The Ordinance authorises the infliction of the "cat" in cases

which fall within the section of the Larceny Ordinance (Ordinance No. 5

of 1865) dealing with robbery with violence, and the infliction of the

birch in the case of offences against the two sections of the Offences
