Hon. Colonial Secretary,

The Consul-General U.S.A. called on me and told me that the Police Magistrate had declined to issue

a warrant unless advised to do so by me.

After a brief consideration of the point

I informed the Consul-General that in my opinion the words in the Extradition Treaty with the U.S.A. "within the jurisdiction of either relate to territorial jurisdiction and not to extra-territorial jurisdiction. I also referred him, without knowing the Magistrate had already done so, to Piggott on Extradition p. 195, and I added that the Magistrate had not consulted me but that I thought he was right and that if asked I should have to advise him accordingly.
