Having regard to the difficulties to which I

have referred and to the fact alluded to in the last preceding

paragraph I would advise, as the period pending the retirement of

the Chief Justice is short, that the procedure should for the

present remain in statu quo, and as I am going home on leave next

month I would seek the opportunity of conferring further with the

legal advisers of the Secretary of State on the subject generally.

As to the question of a Second Puiane Judge I

desire to say whilst, as stated in the enclosure to Sir Henry May's

Despatch of 22nd. October last, I gave as my opinion that in normal

conditions with a proper allocation of work as between the two

Judges a third judge is not necessary I desire to reiterate that

for the purposes of reconstituting the Court of Appeal a third

Judge is urgently required and unless the proposal of appointing

one of the Shanghai Judges is practicable I doubt whether any

other satisfactory means can be devised of meeting the case.
