WITH reference to my despatch No. 162 of the 22nd July, 1907, I have the
Tokyo, August 25, 1910. honour to transmit to you herewith copy of a despatch which I have received from His Majesty's consul at Dairen, reporting an amendment in the Customs Regulations for the leased territory of Kwantung.

I HAVE the honour to report that there appeared on the 5th instant in the
Dairen, August 12, 1910. Kwantung Government General Gazette an ordinance annulling the second paragraph of article 2 of the Provisional Customs Regulations for the leased territory, reported in my despatch No. 37 of the 31st July, 1907.
Produce raised in the leased territory or goods manufactured therefrom con- sequently now pay import duty, if they are sent into the interior.
The Commissioner of Customs informs me privately that he is protesting, not against the amendment, which from our point of view seems desirable enough, but against the manner in which it has been made. He was not consulted beforehand, and, in his opinion, the Japanese authorities are not justified in making alterations of any kind in the regulations without first approaching the Commissioner of Customs at Dairen.
Mr. Tachibana (Commissioner of Customs) also hinted to me that this amendment was the result of a protest made by His Majesty's Government at the instance of His Majesty's Minister at Peking, but I have not heard anything of it.
