With regard to all matters connected with the application to the British High Court of Justice, the responsibility will rest entirely with the British and Chinese Corporation, and shall have no concern for China. The fees of the High Court of Justice will be paid by this directorate-general. If it shall be necessary for the director-general to join his name in the application. the director-general must satisfy himself that there are no grounds for objection and he can theo affix his signature.

There is another point. If the Kiangsu and Chekiang Railway Companies submit to the carrying out by the Yu-Chuan Pu in every particular of the provisions of the Shanghae Hangchow-Ningpo Railway Loan Agreement of the 4th day of the 2nd mouth of the 34th year of Kuanghsü, then the various sums previously expended for railway purposes by the Kiangsu and Chekiang Railway Companies shall all be paid out of the loan funds.

The various provisions above recited have all been verbally settled and agreed upon by the present parties, and you are now requested to be so good as to write a letter in reply confirming the same.

Foreign Office, February 7, 1910. CHINESE Government have issued Imperial edict inviting applications from native financiers for concessions of Hukuang Railway. This is in direct violation of preliminary loan agreement of 6th June. Sir J. Jordan was instructed 2nd February to consult with his United States, French, and German colleagues as to advisability of addressing immediate joint protest to Wai-wu Pu.

We have since heard that German and French Ministers are in favour of sending in identic note of protest to Chinese Government, and His Majesty's representative has been authorised to join.

United States chargé d'affaires will abstain on ground that United States were not a party to agreement of 6th June.
