I am commanded by the Army Council to acquaint

you that they have had under their consideration the

despatch of the 19th November last from Sir F.D.Lugard,

with regard to the Crown Rent on Spring Gardens,

forwarded with Mr. Bertram Cox's letter of the 1st

Garv

January last, No. 41369/1909, and to request that you

will lay before the Earl of Crewe the following remarks

thereon.

2. In paragraph 4 of his despatch, Sir F.D.Lugarā

observes that paragraph 5 of the Memorandum enclosed with

the Colonial Office circular of 9th June 1890 expressly

excepts lands and buildings "purchased and paid for by

the Imperial Government". I am to observe that the

contention of the Army Council in this case is that the

War Department should receive credit in the Colonial

Military Lands Account in respect of the Crown Rent only,

which, not having been purchased by the Imperial

Government, is not affected by the paragraph quoted.
