Notice to Chinese Seamen in British Ships.
The attention of Chinese seamen is called
to the provisions of the Workmen's Compensation Act 1908, which
applies to seamen who are members of the crew of any British
Ship registered in the United Kingdom or of any other British
Ship of which the owner, managing owner, or manager resides, or
has his principal place of business in the United Kingdom.
The Act provides for compensation to Sea-
-men who, through accidents arising out of and in the course of
their employment are disabled from earning their ordinary wages, or, if the accident results in death, for compensation to any
persons who are dependent on the deceased. The person liable to
pay this compensation is the owner or owners of the ship.
Notice of the accident must be given as
soon as is practicable, except when the accident happened, and
the the incapacity commenced, on board the ship, in which case no
notice is required.
The claim for compensation must be made within six months from the date of the occurrence of the
accident causing the injury, and, in case of death, within six
months after news of the death has been received by the claimant
Notice of the accident, and the claim for
compensation, may be served on the Master of the Ship.
Legal proceedings for the recovery of the
compensation can only be taken in the United Kingdom.
Persons having claims should seek legal
advice as to the proper method of recovering any compensation
due to them.
