This Ordinance substitutes one month's notice to the owner of the land which if he cannot be found is, following the Principal Ordinance, to be affixed upon a conspicuous part

of the land to be resumed. It does not require a notice in the

Gazette which in the New Territories is I understand seldom seen,

and the Board of Arbitrators is to consist of a Magistrate or a

Justice of the Peace nominated by the Governor and two other --

members one nominated by the Governor and the other by the owner

of the land.

These changes are effected by sections 3, 4 and 5 which are

to apply in lieu of sections 3, 4 and 5 of the Principal Ordiname

Section 6 gives a general power of entry upon the land when notice of intended resumption has been given whetherTM under the Principal Ordinance or this Ordinance.

Section 7 provides for the payment of compensation in the case of an absent ower. Considerable hardship has been entailed in some instances under the Principal ́Ordinance owing

to the owner being away from the Colony indefinitely, and his whereabouts being unknown and payment having to be withheld from

Precedent to some his family who have been in need of money. extent exists for this section in the Land's Clauses Consolida- -tion Act 1845 (sec. 76) where in the case of an owner who is absent or cannot be found the compensation is deposited iñ ä

The words "subject to any conditions or not" ̈will enable the Governor to require the money to be invested If it is thought

proper to do so.
