The

voyage to Durban is a voyage of over 30 days. Schedule 'A'

of the Passenger Act 1855 contains the regulations

respecting Chinese Passenger Ships proceeding on a voyage

of over 30 days duration. Under the definition of Emigra-

-tion Officer in Ordinance 1 of 1889 the necessary

inspection under these regulations can be made by

deputy. This apparently is frequently the practice. On the

other hand the rules under the Indian Emigration Act

and those made by the Transvaal Government require

personal inspection by the Emigration Officer in each case.

This distinction was overlooked

when I wrote, as Colonial Secretary, my minute of the 7th.

of May, 1908.

Nevertheless the view I formed

then, and which I have held ever since, is that the duty

imposed on the Harbour Master by Ordinances 13 of 1904 and

4 of 1908 are not of such an extraordinary nature as to

demand greater special remuneration than they have re-

-ceived.
