being no Full Court in existence before which the parties
could argue the matter on appeal, they finally agreed to a
compromise and abandoned this appeal to the Privy Council
of which they had given notice.

In September last the Attorney
General opposed before the Chief Justice the discharge upon
a writ of Habeas Corpus of a Chinese named Sun A Wan whose
extradition had been applied for and who had been committed
to Prison pending the Governor's Order for extradition.
The Chief Justice (Sir F. Piggott) ordered the
discharge of the prisoner and subsequently, after argu-
ment, ordered the Government to pay all Sun A Wan's costs
both in the Police Court and in the Supreme Court.
The Government decided to appeal from Sir F.
Piggott's decision ordering the Government to pay these
costs and a motion of appeal was duly filed and served for
hearing when the respondent's Solicitor wrote to the Crown
Solicitor stating that he was instructed to oppose the
hearing of the appeal before the Acting Chief Justice (Mr.
Rees Davies) on the ground that the Acting Chief Justice
had been as Attorney General an interested party in the
proceedings.
