I am directed to communicate with you on the subject
of the Government telephones in Hongkong and the proposed
amendment of the Tramway Ordinance 1902.
You are no doubt aware that for some years past the
Government of Hongkong have intimated that they had a claim
against us for charges in connection with the renewal of the
telephone lines. This culminated in July 1908, when the

Government presented a bill for $39328.30. repudiated all liability in connection with the claim, as
they contend that this Company, in carrying out its powers
under the Ordinance, is not liable for indirect damage to the
telephone system, and, further, that the tests made before and
after the Tramway commenced to work, shew conclusively that the
telephones were no worse after the Tramway commenced than before; and it therefore seemed to my Board that the Government
are claiming to have their defective telephones put right at
this Company's expense. Upon our repudiation, the Hongkong
Government intimated that they would proceed against us, and
we are accordingly waiting for them to take action in the
Courts in the usual way.
