With reference to your letter No.713/1908-9 of

the 20th of May last respecting the provision of

passages to Shanghai for prisoners who have been tried

there and who have served their sentence in Hong Kong,

I am directed by Secretary Sir E. Gray to transmit to

you herewith for the information of the Earl of Crewe

copy of a despatch from the Judge of His Majesty's

Supreme Court at Shanghai, in which certain sugges-

tions are made with regard to the Power of that Court

to order deportation from China and Corea.

In view of the terms of Sections 7 and 8 of the

Foreign Jurisdiction Act Sir E. Grey is not satisfied

that there is adequate statutory authority to enact

the Order in Council as suggested by Sir H. de Saus-

marez. It will be observed that by clause 2 (a) of
