I INCLOSE copy of a telegram received from Mr. Hillier to-day.
It seems to me that if the European veto on the expenditure of funds can really be made effective, it matters little whether it operates through auditor or engineer; but on this point we are taking the opinion both of counsel and of our consulting engineers, and I shall communicate to you their opinion in due course. It is doubtful, however, if we shall be able to obtain it before Tuesday or Wednesday of next week, and I am wiring Hillier to-night to that effect.

Peking, April 16, 1909. REFERRING to your telegram of 13th, what is your opinion as to following amendment Tien-tsin-Pukow Railway 5 per Cent. Loan, 1908, Article No. 14, line 20:
Accompanied auditor's statement particularizing expenditure drawn for copies of indent and (or) vouchers being furnished to him for that purpose by the department concerned?" With reference to foregoing, we propose defer discussion other alterations pending settlement of this. Before replying, we suggest obtain counsel's opinion can bank withhold payment in event of auditor's statement not furnished. Reply by wire as soon as possible.
