that in the present case there is no intention of

relinquishing altogether the War Department rights in

the area in question, but it is merely proposed to allow

an Admiralty occupation for defence purposes.

Moreover

the proposed arrangement is to a certain extent

experimental, and, under the circumstances, it is

considered that Memorandum of Transfer between this

Department and the Admiralty will meet the case.

3 I am further to state that the Army Council

could not in any case agree to relinquish the land in

question without a credit in the Account, as would be

the case if the procedure suggested in the Governor's

despatch of 23rd June 1909 were adopted.

4. In the circumstances stated above the Army

Council regret that they are unable to agree with the

views expressed in the letter of the Governor, dated

23rd June, 1909.
