With reference to your letter of the 30th

March 1909, No: 9331/09, on the subject of the Crown

rent on Spring Gardens, Hong Kong, I am commanded by the Army Council to observe that the points put forward
by the Governor appear to be
(a) that the property does not fall under the
operation of the circular despatches of the
9th June 1890 and 30th December 1894; and
(b) that the War Department should now credit the
Colonial Government in the Colonial Military
Lands account with the capitalized value of
the crown rent and then, when the site is
sold, the Colonial Government will make a
corresponding entry on the debit side.
2.
In regard to (a) I am to refer you to paragraph
11 of War Office letter of the 2nd December 1908, Hong Kong 8/63, and to add that Mr. Findlay Smith's land
and the Mount Austin Hotel property referred to have,
with the consent of the Colonial Government and
