In reply to your letter of the 11th. instant

requiring me to state in writing the grounds upon which I rely

as exculpating me from the charge of breaking No. 40 of the Rule✅

and Regulations for His Majesty's Colonial Service, I have the

honour to state as follows:-

I have never been furnished with a copy of the said

Rules and Regulations, and until about five years ago I had not

seen the same, but it has nevertheless always been understood

by me that I should not be permitted to engage in business of

any kind which might possibly tend to interfere in any WBY

with the proper performance of my duties. I have, therefore,

never been so engaged, but have devoted the whole of the time

and attention which has been required of me in zealously per-

-forming my duties.

It has never occurred to me that there could be any

objection whatsoever to my investing in the Colony, or else-

-where, moneys saved or acquired by me in such manner as seemed

to me to be most advantageous so long as I did not thereby

prejudicially affect the due performance of my duties as Bailiff

of the Supreme Court, and as a Government servant.

It is true that, partly for the sake of the friend-

-ship I then bore him, and partly because it appeared to ma

that I might thereby be making a profitable investment, I advanc-

-ad to John Tatam, on the 24th. September, 1895, a sum of

$1,500 for the purpose of enabling him to commence the business

of a butcher and compradore in the Central Market, and that it was agreed between us that, in lieu of interest thereon, he

should pay tà me half the profits he might earn in carrying on

the said business; but it was further distinctly agreed that I
