With reference to your letter of the 15th. August, 1907, No. 379/29/131, on the above subject, I am directed to inform you that it is recognised that in 1859, when the War Department purchased the residue of the lease, the Colony waived the Crown Rent, and that the waiving was in fact a contribution by the Colony to its permanent defence fund. To decline to credit the War Department in the Colonial Military Lands Account with the capitalized value of the Crown Rent at 25 years purchase now that it is being re-imposed by the Colony would result in a diminution of the said defence fund, the integrity of which has to be preserved in kind or value by the Colony under paragraph 3 of the Circular of 30th. December, 1894. Moreover, such a departure from the present practice as laid down in War Office letter of 2nd. April, 1907, H.K.8/17, to the Colonial Office (a copy of which was sent to you on the 19th. April, 1907) and concurred in by the Governor in his
despatch No. 126 of the 15th. May, 1907, to the Colonial Office because the Crown Rent had been waived in the past, would
amount to a re-opening of the transaction, which is opposed to
paragraph 10 of the Circular of 30th. December, 1894.
I am, therefore, to request you to put these
views before the Colonial Government. Should they still adhere
to their present opinion, on receipt of a report from you,
matter will be referred to the Colonial Office.
