sir,

Supreme Court, Hongkong,

23rd. September, 1909.

Me 9 DEC 09.

I have the honour to acknowledge Your

Excellency's letter of 15th. September in which you inform me

that, Kr. Justice Gompertz having confirmed the statements which I made in my application for leave, Your Excellency has no objection to my taking my leave in the manner I proposed. I

rerret that Your Excellency should have thought it necessary to

seek for confirmation of ry statements, more especially as I have taken short leave on two previous occasions while Your

Excellency has been in the Colon.

2.

Excellency expressed to Mr. Justice Gompertz acting as Chief

Justice has also been removed.

3.

There are a few points in Your Excellency's

letters of 10th. and 12th. September which I think it necessary

to clear up.

*rremol

wonder tell /

Mr. Rees Davies' application for a short

extension of leave was apparently not refused in consequence

of the uncertainty of the date of ng departure. He in fact

obtained the fortnight's extension he applied for.

I feel compelled to derur to Your Excel-

-lency's statement that I strongly recommended Mr. Rees Davies

to act as Chief Justice. My recomendation was on the contrary most lukewarm, as a reference to my memorandum on the subject will

remind Your Excellency.

4.

With regard to my taking short leave

immediately before going on leave, I do not see, with deference,

why a precedent should be necessary. It is convenient to me
