I have examined the accompanying Ordinance, entitled
In Ordinance to amend the Chinese Extradition Ordinance, 1889.
nd I am of opinion that the Ordinance is one which is not contrary to

the Governor's Instructons
The amendment is made on the suggestion of the Chief Justice who has
pointed out that the provision requiring his attendance at the
Aecutive Council to assist in the consideration of a question
Whether an alleged fugitive criminal should be surrendered might lead
His Honour being placed in an embarrassing situation, as a fugitive hose surrender had been decided upon, might thereafter apply to the ler Justice for a writ of Habeas Corpus to test the validity of an order for his surrender.
